§ 8-19A-22. Burden of proof; civil proceeding; criminal proceeding
In any civil proceeding alleging a violation of this chapter, the burden of proving an exemption specified
in Section 8-19A-4 or that the person or entity is not otherwise subject to this chapter is upon the person or
entity claiming the exemption. In any criminal proceeding alleging a violation of this chapter, the burden of
producing evidence to support a defense based upon an exemption specified in Section 8-19A-4 or that the
person or entity is not subject to this chapter is upon the person or entity claiming the defense.
