La. R.S. 45:813
§ 813 Registration with the commission; bond
A.
Prior to the utilization of ADAD equipment to call telephone numbers located in this state, any company
or individual utilizing this equipment shall register the following with the commission to receive a permit as
provided in this Chapter:
(1)
Name, address, and telephone number of the company or individual utilizing the equipment.
(2)
Name and address of a designated agent for service of process located in this state for the ADAD
operator.
(3)
A surety bond executed by the ADAD operator from a surety company authorized to do business in this
state for the sum of ten thousand dollars to be maintained continuously in full force and effect. The
commission may waive the bond requirement for any operator demonstrating financial responsibility by the
submission of a letter of credit from an accredited financial institution or by other means as the commission
by rule may prescribe.
B.
The commission shall promulgate rules and regulations to govern the issuance of and the revocation or
suspension of permits for ADAD operators utilizing equipment to call telephone numbers located in Louisiana.
C.
Failure to obtain a permit from the commission prior to utilization of ADAD equipment to call numbers
located in this state, and failure to abide by commission rules governing ADAD operations shall be a violation
of this Chapter.
D.
It shall be unlawful for any person to connect any ADAD equipment to any telephone line in this state
for the purpose of making telephone calls to persons in this state through the use of ADAD equipment unless a
permit has been issued for such ADAD equipment by the commission.
E.
Any person desiring to use ADAD equipment in this state shall make application for a permit to the
commission on forms prescribed by the commission, and shall pay a fee as prescribed by the commission for such
permit. Permits shall be renewed annually as prescribed by the commission and upon payment of a renewal fee.
The fees charged shall cover the administrative cost for the issuance of such permits.
F.
Permits shall be subject to suspension or revocation by the commission for any violation of this
Chapter.
G.
The provisions of this Section relative to registration with the commission, posting of a surety bond,
and the promulgation of rules and regulations by the commission shall be applicable to those companies or
individuals who utilize live operators to make calls pursuant to R.S. 45:811.
